e-Discovery

Electronic documents are becoming the dominant form of evidence requested for civil and criminal litigation purposes. Producing e-evidence is not always an easy task. According to Law.com, more than 90 percent of new business records are created electronically, and 40 percent of them are never converted to paper (1). There is also growing evidence that many organizations are unprepared for litigation or criminal prosecution in the digital age.

Our computer forensic examiners and advisors are CFCE, SCERS, CIFI, EnCE, CISSP, Cell and PDA Certified Forensic Examiners with witness/expert witness testimony experience.

i-fact@nalysis offers a global alliance of trained professionals who can provide clients with the following e-Discovery services:

  • Collection, preservation, and examination of client-owned digital media, including but not limited to e-mails, computer networks, computers, cameras, cell phones, personal digital assistants (PDAs), flash or thumb drives, networking devices, GPS, video, and other digital media.
  • Computer forensics and technical investigations conducted via utilization of a wide variety of advanced computer and software technologies.
  • Cost-effective analysis by trained investigators of information recovered from client owned digital media or computers in a manner that is defendable in an internal administrative, or in civil or criminal proceedings.
  • Ability to document and maintain electronic evidence chain of custody.
  • Preparation of technical investigative reports, written work product, communications and/or other documentation associated with conducting technical investigations.
  • Consultation with client legal group in connection with potential employee privacy issues, legal concerns, and trial preparation.
  • Ability to testify at administrative, civil and/or criminal hearings as deemed appropriate by the client and/or the client legal group.
  • Consultation in regards to the development of corrective actions as a result of investigation findings, including improving any identified control weaknesses and process flaws within the client’s IT infrastructure and day-to-day business environment.

e-Discovery and Litigation Project Management

The Federal Rules of Civil Procedures (FRCP) and the e-Discovery amendments require organizations follow strict compliance guidelines. These driving forces present significant challenges to organizations conducting e-Discovery initiatives, which must follow a defined set of procedures to produce defensible results.

Having a project manager who directs the action is paramount to your success in any e-Discovery and litigation event. The cost of e-Discovery can be excessive and the project manager can identify and reduce costs and maintain the focus and timelines required to be successful. In a time when electronic data resides within an organization in both structured and unstructured formats, it is vitally important to have trained professionals managing the collection process.

The trained professionals at i-fact@nalysis can provide project management functions for all e-Discovery litigation processes. We tailor our services to work in sync with our clients' requirements to ensure success at all stages of e-Discovery.

We provide support and guidance to identify, collect, preserve, process and review the production of data in a format that meets the requirements of the customer and ensures compliance to the FRCP and e-Discovery amendments.
